1. Agreement to These Terms

These Terms of Service govern your use of moderncraftconstructionllc.com (the “Site”), operated by ModernCraft Construction LLC (“ModernCraft,” “we,” “us,” or “our”), a Kansas limited liability company.

By using the Site or submitting an estimate request, you agree to these Terms. If you do not agree, please do not use the Site.

These Terms govern the Site and estimate-request process only. They do not govern construction work performed by ModernCraft. Any construction work is governed by a separate written contract for the specific project and by applicable federal, state, and local law. If these Terms conflict with a signed construction contract, the signed construction contract controls with respect to the project.

2. Our Services

ModernCraft provides residential remodeling and painting services in the Kansas City metropolitan area in Kansas and Missouri, subject to applicable licensing, permitting, and other legal requirements.

Our residential services may include interior and exterior painting, kitchen and bathroom remodeling, finish carpentry, flooring installation, and other residential remodeling and renovation work.

ModernCraft also provides commercial painting services. We do not provide commercial remodeling services.

Descriptions, photographs, and project galleries on the Site are provided for general informational and illustrative purposes. Every property and project is different, and Site content does not guarantee that a particular project will have the same scope, appearance, price, schedule, or result.

3. Estimate Requests

The Site allows you to request an estimate. Submitting an estimate request does not create a construction contract, guarantee acceptance of a project, reserve a place on our schedule, or obligate either you or ModernCraft to proceed with work.

You agree to provide accurate information when submitting a request. By providing your contact information, you authorize ModernCraft to contact you about your request by phone, text message, or email.

You must be at least 18 years old to submit an estimate request. For work involving real property, you must be the property owner or have authority from the owner to request the work.

We may accept or decline a request based on project scope, location, scheduling, availability, or any other lawful business reason.

4. Estimates and Construction Contracts

Information or pricing discussed through the Site, by phone, by email, or during an initial conversation or walkthrough does not by itself create a construction contract.

No construction project is under contract until ModernCraft and the customer have entered into the applicable written construction contract.

The signed construction contract governs the project’s scope of work, price, payment terms, schedule, change orders, warranties (if any), project-specific responsibilities, dispute procedures, and other construction-related terms.

Conditions that are concealed, unknown, or not reasonably observable before work begins may affect the scope, price, or schedule of a project. Any additional work will be handled according to the applicable signed construction contract and applicable law.

5. Use of the Site

You may use the Site to learn about ModernCraft and its services and to contact us regarding potential work.

You may not use the Site to submit fraudulent or misleading information, send spam or automated requests, introduce malicious code, attempt unauthorized access to the Site or related systems, interfere with the Site’s operation, or use the Site in violation of applicable law.

We may restrict access to the Site when reasonably necessary to protect the Site, ModernCraft, or other users.

6. Intellectual Property

Unless otherwise stated, the text, design, layout, ModernCraft Construction name and logo, and original photographs and other content created by or for ModernCraft are owned by ModernCraft Construction LLC or used with permission.

You may view the Site for personal, non-commercial purposes. You may not reproduce, republish, distribute, or commercially use ModernCraft-owned Site content, photographs, name, or logo without permission.

Some images or other materials appearing on the Site may be licensed from third parties and remain the property of their respective owners.

Permission to photograph or publish a customer’s completed project is governed by the applicable signed construction contract or a separate written authorization. We do not publish a customer’s name or street address with project photographs without separate permission.

7. Third-Party Services and Links

The Site may use or link to third-party services, including hosting, analytics, maps, email services, social media platforms, or other online services. ModernCraft does not control third-party services and is not responsible for their independent content, availability, or practices.

Our Privacy Policy explains how information submitted through or collected by the Site is handled.

8. Governing Law for Site Use

These Terms, solely as they relate to use of the Site and the estimate-request process, are governed by the laws of the State of Kansas, except where applicable law requires otherwise.

Any dispute arising solely from use of the Site will be brought in a court of competent jurisdiction in Johnson County, Kansas, unless applicable law requires a different forum.

These Site Terms do not determine the law, venue, or dispute-resolution procedure governing construction work. Construction projects are governed by the applicable signed construction contract and mandatory federal, state, and local law. Projects performed in Kansas are subject to applicable Kansas requirements, and projects performed in Missouri are subject to applicable Missouri requirements.

Nothing in these Terms waives any consumer, cancellation, lien, or other right that cannot legally be waived.

9. Changes to These Terms

We may update these Terms from time to time. The current version will be posted on the Site with an updated “Last Updated” date.

Changes to these Terms do not modify a construction contract that has already been signed. A signed construction contract may be modified only as permitted by that contract or by another written agreement between the parties.

10. Severability

If any provision of these Terms is found unenforceable, it will be limited or removed only to the extent necessary, and the remaining provisions will continue in effect.

Our failure to enforce a provision of these Terms does not waive our right to enforce it later.
